There Is No 3-Day Right to Return a Car in Florida
The most expensive myth in car buying goes like this: "If something is off, I have three days to return the car." Those three days do not exist — not under federal law and not under Florida law.
Where the myth comes from
There is a federal Cooling-Off Rule, and it does give you three days to cancel. But it was written for sales made away from the seller's place of business: a salesperson at your home, a pitch in a rented hotel room, a booth at a fair.
A purchase at a dealership is excluded by design: sales at the seller's permanent place of business are carved out. The rule also separately excludes car dealers even when they sell off-site — at a tent sale, for example — as long as they have a permanent place of business. The dealer is excluded twice.
What Florida says
Florida's Department of Highway Safety and Motor Vehicles puts it plainly: many consumers believe they have three days to cancel a purchase contract, but there is no cooling-off period under Florida law. Once you sign, there is very little you can do to undo it.
The only mechanism that sometimes rolls a deal back is the financing-approval clause in the contract. But the dealer wrote it, and it works for the dealer: if the lender doesn't approve the terms, the dealer can call you back to re-sign. You have no matching right.
What follows from it
All of your protection lives before the signature, not after. Checking the buyer's order, reading the contract, declining add-ons, comparing offers from several dealers — all of it matters only until the moment you sign.
- Don't sign the same day if you haven't read the whole contract.
- Get the out-the-door price in writing, line by line, before any talk about payments.
- Don't drive off until the financing is final.
If you're being rushed, say this out loud:
I don't sign anything today until I've read the full contract.
